This promotion ran by Skype Communications S.A. (“Skype”) is subject to the following terms and conditions, and all participants will be deemed to have accepted and to have agreed to be bound by these terms and conditions:
1. This promotion is open to all Skype users. Skype reserves the right to verify the eligibility of users.
2. This promotion shall be available from December 20th 2006 until February 28th 2006. The band will review a selection of the entries to determine the winner. Skype reserves the right to either extend or shorten the promotional period or to suspend, change or cancel the promotion at any time.
3. All participants are deemed to irrevocably authorize Skype to use the statements left on the Skype voicemail, their voices, names, cities, countries of residence or any other information or material provided to Skype (together, the “Material”), as appropriate, in connection with this promotion. Participants understand that Skype may edit the Material due to space considerations or for any other reason and hereby consent to such editing or alteration.
4. Participants acknowledge that all right, title and ownership in and to the Material, including any and all copyrights shall, to the extent allowed under applicable law, be the exclusive property of Skype.
5. Any data collected and use thereof shall be subject to Skype’s Privacy Policy.
6. Skype shall not be liable in contract or tort (including negligence) or breach of statutory duty or in any other way, for any loss or damage arising suffered by the participant resulting directly or indirectly from this promotion, to the extent allowed under applicable law.
7. Skype reminds participants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect access to the promotion.
8. Although Skype will use reasonable efforts to ensure that all information relating to the promotion is accurate, Skype will not be responsible for any inaccuracies found therein.
9. If Skype has suspicions or knowledge that any participant has misused the promotion or been involved in any fraudulent or illegal activity relating thereto, Skype reserves the right to exclude participants from this promotion at any time and at its sole discretion.
